Despite the firm\u2019s role in the trust\u2019s portfolio, BlackRock mischaracterized Aviron as a \u201c<strong>Diversified Financial Services<\/strong>\u201d entity in multiple annual and semi-annual reports. Additionally, BlackRock claimed higher interest rates paid by Aviron than were actually the case. The discrepancies were later <strong>identified and corrected<\/strong> by BlackRock in 2019.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Aviron Group LLC was contracted to fund filmmaking on behalf of BlackRock and the S.E.C. decided to charge BlackRock immediately following a direct listing to the D.T.C.C. for\u2026 ( loophole ) improperly describing the investments on the contract with Aviron Group LLC.<br \/>Basically a\u2026 <a rel=\"nofollow\" href=\"https:\/\/t.co\/GQQaA2RfRb\">pic.twitter.com\/GQQaA2RfRb<\/a><\/p>\n<p>\u2014 M\u00f6bius (Founder of SWAG) (@SWAccelerated) <a rel=\"nofollow\" href=\"https:\/\/twitter.com\/SWAccelerated\/status\/1717024813359710479?ref_src=twsrc%5Etfw\">October 25, 2023<\/a><\/p>\n<\/blockquote>\n<p>The SEC\u2019s investigation was led by Salvatore Massa and Brian Fitzpatrick under the supervision of Andrew Dean and Corey Schuster, all part of the <strong>Enforcement Division\u2019s Asset Management Unit<\/strong>.\n<\/p>\n<h2>Parallel Events: The Case of the Spot Bitcoin ETF<\/h2>\n<p>\nThe SEC\u2019s announcement against BlackRock occurred on the same day the firm\u2019s spot Bitcoin ETF appeared on the Depository Trust &amp; Clearing Corporation (DTCC) listing. <a rel=\"nofollow noopener\" href=\"https:\/\/twitter.com\/EricBalchunas\" target=\"_blank\">Eric Balchunas<\/a>, a senior Bloomberg ETF analyst, noted that the <strong>DTCC listing<\/strong> was \u201call part of the process\u201d for bringing a Bitcoin ETF to market. The spot Bitcoin ETF vanished from the DTCC platform for several hours before reappearing, however, sowing confusion among market watchers.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">JUST IN: BlackRock&#8217;s iShares Spot <a rel=\"nofollow\" href=\"https:\/\/twitter.com\/hashtag\/Bitcoin?src=hash&amp;ref_src=twsrc%5Etfw\">#Bitcoin<\/a> ETF relisted on the DTCC (Depository Trust &amp; Clearing Corporation). <a rel=\"nofollow\" href=\"https:\/\/t.co\/2Gu0gKjhed\">pic.twitter.com\/2Gu0gKjhed<\/a><\/p>\n<p>\u2014 Watcher.Guru (@WatcherGuru) <a rel=\"nofollow\" href=\"https:\/\/twitter.com\/WatcherGuru\/status\/1716937268848734355?ref_src=twsrc%5Etfw\">October 24, 2023<\/a><\/p>\n<\/blockquote>\n<p>A DTCC spokesperson clarified that the iShares Bitcoin ETF has been on the platform since August and stated the listing is <strong>not a signal<\/strong> of any impending regulatory approval.<\/p>\n<p>The recent charge occurred amid heightened scrutiny from the SEC over firms dealing with cryptocurrency assets\u2013 and the SEC\u2019s action against BlackRock could have larger <strong>implications for crypto regulation<\/strong>. This is particularly important since BlackRock, along with other financial institutions, is waiting for the SEC\u2019s decision on their respective Bitcoin ETF applications.
