Now-defunct cryptocurrency exchange\u00a0FTX<\/strong>\u00a0has filed a complaint against former CEO\u00a0Sam Bankman-Fried<\/strong>\u00a0and other key executives to retrieve more than $1 billion in allegedly misappropriated funds.\u00a0<\/p>\n

The lawsuit, filed by FTX\u00a0under the direction\u00a0of an executive team led by restructuring expert John Ray, named former Alameda Research CEO\u00a0Caroline Ellison<\/strong>, FTX co-founder\u00a0Gary Wang<\/strong>, former FTX engineering director\u00a0Nishad Singh<\/strong>, and Bankman-Fried as defendants.\u00a0<\/p>\n

The complaint alleged that FTX executives breached their fiduciary duties by misappropriating customer funds on a \u201ccontinuous basis to finance luxury condominiums, political and \u2018charitable’ contributions, speculative investments and other pet projects.<\/p>\n

One stance FTX lawyers mentioned in the lawsuit was Bankman-Fried’s $10 million gift to his father, distinguished legal scholar Joe Bankman.<\/p>\n

The lawsuit claimed that the amount was routed from FTX to Bankman-Fried\u2019s\u00a0Morgan Stanley<\/strong>\u00a0and\u00a0TD Ameritrade<\/strong>\u00a0accounts around January 2022.<\/p>\n

Likewise, the attorneys alleged that Bankman-Fried and Wang used customer funds to purchase $546 million worth of shares in the trading platform Robinhood.<\/p>\n

As reported, these shares became a center of contention with four entities laying claim to them.\u00a0<\/p>\n

Bankrupt\u00a0crypto lender BlockFi, which is also an FTX creditor, FTX’s new management, as well as the US government wanted to keep a grasp of the shares.\u00a0<\/p>\n

However, the US Department of Justice eventually\u00a0retained control of the shares.\u00a0<\/p>\n

The lawsuit also claimed that Ellison paid herself $28.8 million in bonuses and used $10 million of the funds to purchase a stake in an artificial intelligence company.<\/p>\n

Former FTX Executives Made Fraudulent Transfers as the Platform Was Insolvent<\/h2>\n

The filing said many of the alleged fraudulent transfers occurred while the exchange was insolvent.<\/p>\n

While FTX initially prohibited accounts carrying a negative balance, Bankman-Fried allegedly directed his associates to modify the exchange\u2019s code.<\/p>\n

\n

\u201cIn or around July 2019, Bankman-Fried directed one or more of his co-conspirators or individuals working at their behest to modify the software to permit Alameda to maintain a negative balance in its account on the exchange.\u201d<\/p>\n<\/blockquote>\n

Nevertheless, the recent FTX lawsuit opens a new front in Ray\u2019s efforts to reclaim assets to pay back creditors of the crypto exchange.\u00a0<\/p>\n

More recently, FTX lawyers filed a court motion seeking the\u00a0recovery of $323.5 million\u00a0from the leadership of\u00a0FTX Europe<\/strong>, which includes\u00a0Patrick Gruhn<\/strong>,\u00a0Robin Matzke<\/strong>,\u00a0Brandon Williams<\/strong>, and\u00a0Lorem Ipsum UG<\/strong>.\u00a0\u00a0<\/p>\n

The lawyers alleged that the FTX Europe leadership improperly used funds from the crypto exchange to acquire Swiss company\u00a0DAAG<\/strong>\u00a0without conducting any due diligence.\u00a0<\/p>\n

Likewise, the company has filed a complaint in Wilmington, Delaware, bankruptcy court,\u00a0asking back the $700 million\u00a0its founder\u00a0Sam Bankman-Fried<\/strong>\u00a0transferred to K5 entities in 2022.<\/p>\n

It is worth noting that last month, FTX debtors revealed that the exchange has made \u201csubstantial progress\u201d in securing assets,\u00a0recovering as much as $7 billion\u00a0in liquid assets so far.<\/p>\n

The exchange owed customers approximately $8.7 billion when it went bankrupt last year.\u00a0<\/p>\n
